Queensland Law Society (QLS) endorses template contracts for the sale of real property published by the Real Estate Institute of Queensland (REIQ). The REIQ/QLS property contracts are the most common form of sale contracts used in Queensland. The terms are settled by the REIQ and QLS and are updated with changes in the law and in technology.
REIQ contracts are provided to QLS Full members only to be used in accordance with the terms and conditions of the licence from the REIQ.
NB: Members are advised that alterations to the Standard Terms of Contract should only be effected via the addition of special conditions.

E-Conveyancing Guidelines
The E-Conveyancing Guidelines have been compiled by the Property & Development Law Committee of the Queensland Law Society. The Guidelines are designed to reflect recommended practice for solicitors who have been retained to act in residential property transactions where the parties have agreed to electronic settlement and lodgement.

30 September 2024 – Corrections made: Members are requested to download the updated Word versions of Contract for Houses and Residential Land (19th edition) and the Contract for Commercial Land and Buildings (10th edition). The edition numbers will not be changed due to the minor nature of the amendments. However, please ensure you have downloaded the Word document with “Sept 2024” in the title. August 2019
Queensland Law Society and the Real Estate Institute of Queensland (REIQ) have prepared new editions of the four standard sale contracts for use by our members. The key changes in the new editions include:
- the addition of e-conveyancing clauses to the Commercial Land & Buildings contract and the Commercial Lots in a Community Titles Scheme contract;
- updates to all e-conveyancing clauses to refer to electronic lodgement network operators generally; and
- updated natural disaster clauses in all four contracts to refer to “Delay Events”, including the imminent threat of such an event.
The new versions also include a blank page at the end of each contract, at the request of members, which will allow members to add schedules or annexes to the document.

QLS and the Real Estate Institute of Queensland have prepared new editions of the standard contracts for use by our members. The changes arise from GST withholding at settlement measures taking effect from 1 July 2018, to facilitate the signing of the contracts by electronic means; and to update references to legislation and notice clauses.

To reflect the Commonwealth Government’s foreign resident capital gains tax withholding framework. A new tax measure applied to the acquisition and disposal of certain taxable property from 1 July 2016. This legislation applied to a range of transactions in addition to the sale of Australian real property. The Commonwealth Government’s foreign resident capital gains tax withholding regime will require the acquirer of certain interests in property to withhold 10% of the cost base of the asset that is being acquired. Although the “cost base” will generally be the purchase price for the asset, practitioners need to be aware that the particular “cost base” will depend on the nature of the transaction.
QLS and the Real Estate Institute of Queensland have prepared amendments to four of the standard contracts to reflect the new tax withholding regime:

1.1 REIQ owns the copyright in the contracts.
1.2 You may only use the contracts for professional work relating to the transfer of an interest in real property.
1.3 "Use" includes printing, publishing, copying or reproducing (including by electronic reproduction) the contracts in any form and by any medium.
You must not:
2.1 Make use of the contracts other than under the terms of this agreement.
2.2 Do anything to prejudice the validity of the copyright in the contracts.
2.3 Raise or cause to be raised any question or objection concerning the validity of the copyright in the contracts.
2.4 Assist any person in objecting to the validity of the copyright in the contracts.
2.5 Sell or otherwise dispose of (whether for reward or otherwise) the contracts.
2.6 Subject to clause 3.1, alter the form of any contracts without the prior written consent of REIQ.
3.1 You may use selected individual clauses from the contract for use in any conveyancing contract involving the sale and purchase of residential or commercial property. However, where only selected clauses are used, you must not state or imply that the clauses:
3.1.1 Have the approval of QLS or that they have been adopted by REIQ, or
3.1.2 Are extracted from the contracts.
3.2 Subject to 3.1, you are required to utilise the entire contract and to place a copyright symbol on the contract indicating that copyright in the contract is held by REIQ.
